16-4-203. Determination of public convenience and necessity. An original license issued pursuant to 16-4-104, 16-4-201, or 16-4-202 or the transfer of location of a license may be approved only if the department has determined, upon a hearing held pursuant to the Montana Administrative Procedure Act, that the issuance or transfer of the license is justified by public convenience and necessity. If there is no opposition to the application for issuance or transfer of the license, a hearing is not required.
