41-3-1142. Issuance of license -- authority of issuing agency. The department is hereby authorized to issue licenses to persons operating youth care facilities and to prescribe the conditions upon which such licenses shall be issued and to make such rules as it may deem advisable for the operation and regulation of such facilities for minor children consistent with the welfare of such children. Such licensing agency shall have the power and authority to inspect all such licensed facilities through its duly authorized representatives and to cancel licenses theretofore issued for the failure to observe such rules. The person operating such homes shall give to such representative such information as may be required and afford him every reasonable opportunity for observing the operation of such homes.
