53-1-102. Removal of patients from state custodial institutions without permission a misdemeanor. (1) A person, other than a parent or one having legal custody of the person of the patient or inmate, who permits or assists a resident patient or inmate of a state custodial institution to leave the institution without permission from the properly authorized member of the staff or proper court order is guilty of a misdemeanor and upon conviction is punishable by imprisonment in a county jail not exceeding 6 months or by a fine not exceeding $500, or both.
(2) Nothing herein is to be construed to conflict with laws relative to inmates of the Montana state prison.
