75-6-221. Loan program. The department may provide financial assistance in the form of a loan to public water systems owned by a governmental agency, an intergovernmental agency, a nonprofit corporation, an Indian tribe, or any combination of those entities, subject to the requirements in 75-6-222 through 75-6-224. The department may provide financial assistance only in the form of a loan to an investor-owned public water system according to priorities established by the department, based on greatest public health needs and financial needs. Prior to making a loan to an investor-owned public water system, the department shall determine that the system has the ability to repay the loan according to its terms and conditions and may require a dedicated source of repayment and impose additional requirements. A loan to an investor-owned public water system is subject to the requirements of 75-6-222 through 75-6-224.
