At twelve o'clock noon the Senate of the 55th Legislature of the State of Montana was called to order with Senator Van Valkenburg presiding.

Senator Van Valkenburg appointed Reverend Tom Banks as temporary Chaplain and Chuckie Cramer as temporary Sergeant-at-Arms of the Senate.

The colors were posted by Lieutenant Westfall and members of the Montana National Guard and Helena Police Department, followed by the Pledge of Allegiance to the Flag.

The invocation was given by Reverend Tom Banks.

Senator Van Valkenburg appointed Rosana Skelton as temporary Secretary of the Senate.

At the direction of Senator Van Valkenburg, the temporary Secretary called the roll of the newly elected Senators by district. The following Senators responded thereto:

The Chief Justice of the Supreme Court, the Honorable Jean Turnage, was admitted to the Senate Chamber and administered the following official oath of office to the Senators-elect who subscribed to same:

"I do solemnly swear that I will support, protect, and defend the Constitution of the United States and the Constitution of the State of Montana, and that I will discharge the duties of my office as a Montana State Senator with Fidelity, so help me God."

At the direction of Senator Van Valkenburg, the temporary Secretary called the complete roll of the Senate. The following Senators responded thereto:

Fifty members being present, Senator Van Valkenburg announced that the Senate of the 55th Legislature was duly organized and ready for business.

MOTIONS

Senator Harp moved that the rules of the Senate and the joint rules of the Senate and House of Representatives of the 54th Legislature be the temporary rules of the 55th Legislature. Motion carried unanimously.

Senator Harp moved that Senator Aklestad of District No. 44 be nominated for the office of President of the Senate of the 55th Legislature and moved that his election carry with it the name of Senator Crippen of District No. 10 for the office of President Pro Tempore.

Senator Franklin moved that Senator Halligan of District No. 34 be nominated for the office of President of the Senate of the 55th Legislature and moved that his election carry with it the name of Senator Van Valkenburg of District No. 32 for the office of President Pro Tempore.

Senator Aklestad was elected President of the Senate by a voice vote; 34 votes for Senator Aklestad, 16 votes for Senator Halligan.

Senator Van Valkenburg announced the election of Senator Aklestad as President and Senator Crippen as President Pro Tempore.

Senator Aklestad assumed the Chair and made his opening remarks:

"Welcome Staff and Pages. I heard that a past Senate President said that he would rather be President of the Senate than Governor. I am not going to go quite that far but being selected President is the highest honor I have had bestowed upon me, and I am very proud to be elected President.

I would like to see the Senate operate under two basic principles. First, that we listen and feel what the majority of the people of Montana are saying and feeling.

1. I think they are saying hold the line on spending. To do so, with regard to the institutions budget which encompasses prisons and juvenile crimes, the general public is going to have to get involved. The economy does not cause crime. Lack of values does. Individuals need to take responsibility for their own lives. Parents need to parent. Teachers need to be able to teach and discipline their students. Community groups and organizations need to step forward with time and energy on the local level.

2. They want fair and reasonable taxation. Reappraisal of homes is not fair and reasonable, and the legislature should not allow massive tax increases to occur.

3. The general public wants common sense rules and regulations with a clean environment and economic growth. We can have both.

The second principle is that we preserve and protect the dignity, integrity and honor of the Senate. In the Senate we have always tried to have a high standard of debate. That does not mean we should not express our differences. It does mean we can remain friends while exercising the process. If we don't, the process has not failed, we have. I am so proud to be a part of that process. Thank you for the honor and the privilege to serve as Senate President. I accept the challenge."

 

Senator Harp presented Senator Aklestad with a hand made, engraved oak step stool so that he could rule the Senate from a lofty position.

Senator Foster moved that Senator Harp of District 42 be nominated for the office of Majority Floor Leader of the Senate of the 55th Legislature and moved that his election carry with it the names of Senator Foster as Majority Whip and Senator Beck as Chair of the Senate Committee on Committees.

Senator Franklin moved that Senator Halligan of District No. 34 be nominated for the office of Majority Floor Leader of the Senate of the 55th Legislature and moved that his election carry with it the name of Senator Franklin as Majority Whip.

Those in favor of Senator Harp voted "YEA". Those in favor of Senator Halligan voted "NAY".

President Aklestad announced the election of Senator Harp as Majority Floor Leader, which carried with it the other nominees named in the motion of Senator Foster. He further announced that Senator Halligan, having received a minority of votes, was therefore elected Minority Floor Leader of the Senate, which carried with it the election of Senator Franklin as Minority Whip.

Majority Leader Harp moved that President Aklestad's appointments of Rosana Skelton as Secretary of the Senate, Chuckie Cramer as Sergeant-at-Arms of the Senate and Reverend Tom Banks as Chaplain of the Senate for the 55th Legislature be confirmed. Motion carried unanimously.

Majority Leader Harp moved that the President appoint a select committee of three to notify the Governor that the Senate was organized and ready for the transaction of business and to invite the Governor to address a joint session of the Senate and the House of Representatives on Thursday, January 16, 1997 at 7:00 p.m. Motion carried unanimously.

The President appointed Senators Jenkins (Chairman), Hargrove and Wilson to notify the Governor.

Majority Leader Harp moved that the President appoint a select committee of three to notify the Chief Justice and associate members of the Supreme Court that the Senate was organized and ready for the transaction of business and to invite the Chief Justice and the associate members of the Supreme Court to attend a joint session of the Senate and the House of Representatives on Thursday, January 16, 1997 at 7:00 p.m. Motion carried unanimously.

The President appointed Senators Grosfield (Chairman), Estrada and Lynch to notify the Supreme Court.

Majority Leader Harp moved that the President appoint a select committee of three to notify the House of Representatives that the Senate was organized and ready for business and that the Senate wished them success in their deliberations. Motion carried unanimously.

The President appointed Senators Keating (Chairman), Miller and Nelson to notify the House of Representatives.

The President excused the committee members to perform their assigned duties.

Senator Harp moved that the Senate stand in recess, subject to the call of the Chair, to await the reports of the select committees. Motion carried unanimously.

The Senate recessed at l:10 p.m.

Senate reconvened at 1:15 p.m.

The committee appointed to notify the House of Representatives that the Senate was organized and ready for business reported that the House extended its best wishes and pledged its cooperation. The message was acknowledged and the committee dismissed.

The committee appointed to notify the Chief Justice and the associate members of the Supreme Court that the Senate was organized and ready for business reported that the Supreme Court was notified. The message was acknowledged and the committee dismissed.

The committee appointed to notify the Governor that the Senate was organized and ready for business reported that the Governor extended his best wishes and pledged his cooperation. The message was acknowledged and the committee dismissed.

MOTIONS

Senator Harp moved that the accredited members of the press, radio, and television be granted the privilege of the Senate floor, subject to the rules. Motion carried unanimously.
