     16-11-145. Place where violations committed a public nuisance. Each person having possession or control of or who maintains a building or place where cigarettes are sold in violation of this part or who permits the cigarettes to be sold in violation of this part in any place or building possessed, controlled, or maintained by that person is guilty of maintaining and keeping a nuisance. The building or place so used, together with the personal property and fixtures used in connection therewith, is considered a nuisance. The person must be enjoined and the building or place, personal property, and fixtures abated as a nuisance at the instance of the state.
