61-5-102. Drivers to be licensed. (1) No person, except those expressly exempted under 61-5-104, shall drive any motor vehicle upon a highway in this state unless such person has a valid Montana driver's license. No person shall receive a Montana driver's license unless and until he surrenders to the department all valid driver's licenses in his possession issued to him by any other jurisdiction. All surrendered licenses shall be returned by the department to the issuing department together with information that the licensee is now licensed in this state. No person shall be permitted to have more than one valid driver's license at any time.
(2) Whenever a city or town requires a licensed driver to obtain a local driving license or permit, such a license or permit shall not be issued unless the applicant presents a state driver's license valid under the provisions of this chapter.
(3) A person operating a bicycle defined in 61-1-123(2) shall have in his possession at all times when operating the bicycle a valid Montana driver's license.
