76-4-1101. Definitions. Unless the context requires otherwise, in this part the following definitions apply:
(1) "Blanket encumbrance" shall be considered to mean a trust deed or mortgage or any other lien or encumbrance, construction lien or otherwise, securing or evidencing the payment of money and affecting land to be subdivided or affecting more than one lot or parcel of subdivided land or an agreement affecting more than one such lot or parcel by which the owner or subdivider holds said subdivision under an option, contract to sell, or trust agreement.
(2) "Board" means the board of realty regulation provided for in 2-15-1867.
(3) "Department" means the department of commerce provided for in Title 2, chapter 15, part 18.
(4) "Subdivision" and "subdivided lands" mean any tract of land which is hereafter divided into five or more parcels, a parcel of which is less than 5 acres in size, and which is offered for sale or lease outside the state of Montana.
