     90-8-205. State liability disclaimed. The state of Montana may not be held liable for any damages to an investor in a Montana:
     (1) capital company that fails to become designated as a certified or qualified Montana capital company; or
     (2) small business investment capital company that fails to become designated as a certified or qualified Montana small business investment capital company.
