50-31-231. (Temporary) Injunctive relief. (1) In addition to the remedies provided in 50-31-509, any person may bring an action in district court pursuant to this section, and the district court has jurisdiction upon hearing and for cause shown to grant a temporary or permanent injunction restraining any person from violating any provision of 50-31-223. The court may award attorney fees to the prevailing party in the action.
(2) The prohibition provided in 50-31-223 does not apply to any wholesale or retail distributor who in good faith makes the same representations on a package or label or in advertising or promotion as have been made by the manufacturer, distributor, or other person providing the food to that wholesale or retail distributor.
