     87-3-206. Unlawful to use explosives or poisons in taking fish. (1) If any person or persons shall use any carbide, lime, giant powder, dynamite, or other explosive compounds or any corrosive or narcotic poison or other deleterious substance or have any of the same in his possession within 100 feet of any stream where fish are found for the purpose of catching, stunning, or killing fish, he shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished as provided by law.
     (2) The provisions of this section shall not apply to anyone duly authorized by the department to conduct lake or stream surveys or to control undesirable or overpopulated species of fish.
