5-2-104. Appointment to or candidacy for other offices. (1) No member of the legislature may, during the term for which he was elected, be appointed to any civil office under the state. A member of the legislature may become a candidate for public office during his term.
(2) A member of the legislature who is elected to other public office shall resign from the legislature prior to assuming the office to which he was newly elected.
