50-70-112. Permits. (1) The department may by rule prohibit the installation, alteration, or use of any machine, equipment, device, or other article which it finds may cause or contribute to occupational disease or which is intended primarily to prevent or control occupational disease, unless a permit has been obtained from it.
(2) The department may require that applications for permits must be accompanied by plans, specifications, and other information that it considers necessary.
(3) The department shall provide for the issuance, suspension, revocation, and renewal of permits which it may require pursuant to this section.
(4) If a permit is required, the department shall decide within 90 days after receiving application whether or not to issue the permit. If a decision is not rendered within that time, permission is considered to have been denied.
