50-71-323. Order directing additions, repairs, improvements, or changes. (1) Whenever the department, after an inspection and a closing conference with an employer and an employee representative, finds that an employment or place of employment is not safe or that the practices, methods, operations, or processes used by the employer are unsafe or do not afford adequate protection to the life and safety of employees in the employment or place of employment, the department shall issue an order outlining the unsafe or inadequate practices, methods, operations, or processes currently used and directing additions, repairs, improvements, or changes in the employment or place of employment that are necessary to protect the life and safety of employees in the employment or place of employment.
(2) The department may in the order direct that additions, repairs, improvements, or changes be made and that safety devices and safeguards be furnished, provided, and used that are necessary to ensure a safe employment or place of employment within the time specified in the order.
