69-14-801. Maintenance of loading platform by railroad. (1) A railroad company doing business in this state shall, within 60 days after notice from the commission, erect one or more safe platforms for the transfer of commodities to cars. The platforms must be erected to not endanger life and property.
(2) If a railroad company, after receiving notice as provided for in this section, fails, refuses, or neglects to erect platforms as required by this section within 60 days, the commission shall notify the railroad company to appear before it at a certain time and place and show cause why the commission should not issue an order requiring the railroad company to comply with the requirements of this section. The commission may, after the hearing, issue an order commanding the railroad company to erect the platform.
(3) A notice required to be served upon a railroad company to carry out any of the provisions of this section or similar provisions relating to the enlarging of platforms may be served upon any agent of the railroad company within the state.
