72-33-622. Capacity of trustee. (1) The trustee must have the legal capacity to take, hold, and transfer the trust property. The trustee may be a natural person or a corporation or trust company. If the trustee is a corporation, it must be qualified to act as a trustee in this state.
(2) A beneficiary of a trust may be the trustee of the trust.
(3) The trustor of a trust may be the trustee of the trust.
