81-4-308. Retrieval of impounded animals a misdemeanor -- penalty. Any person who takes or rescues any animal impounded as provided in 81-4-307 from the possession of the person in whose custody the same may be, without his consent, shall be guilty of a misdemeanor and upon conviction therefor be subject to a fine of not less than $100 or more than $500 or shall be confined in the county jail not more than 60 days or both such fine and imprisonment.
