     32-5-202. (Temporary) Issuance or denial of license. (1) Within 30 days after an application for license is filed with the department together with the required fees, the department shall issue the license, if the character and general fitness of the applicant is such as to warrant belief that the business will be operated lawfully and fairly within the provisions of this chapter, or enter an order denying the license, if it finds to the contrary.
     (2) A copy of the order granting or denying a license, together with a summary of the department's findings, shall be filed in the office of the department and shall be a public record. A copy of the order denying a license, together with a summary of the department's findings, shall be mailed postage prepaid to the applicant at the address stated in the application.      32-5-202. (Effective October 1, 2008) . Issuance or denial of license or license renewal. Within 30 days after a complete application for a license or a license renewal is filed with the department together with all required fees, the department shall issue the license or license renewal if the department determines that the character and general fitness of the applicant warrants the belief that the business will be operated lawfully and fairly within the provisions of this chapter. The department may enter an order denying the license or license renewal application subject to notifying the applicant and providing the applicant an opportunity for a hearing. All notices and orders must be served as provided in 32-5-207(2).
