7-14-2708. Investigation of proposed road -- obtaining releases for damages. The committee and the surveyor or the surveyor's deputy shall:
(1) immediately view, examine, and survey the road petitioned for;
(2) examine and determine the lands that will be specially benefited by the road and that should be included within the district that is to be assessed;
(3) ascertain whether any damage or injury to property will be sustained by or in consequence of the making of the road; and
(a) obtain, if possible without cost, the release in writing of each person of the person's claim for damage or injury; or
(b) arrange, when necessary, for a release to be given for an amount that is fair and reasonable.
