50-20-1005. (Subsections (2) and (3) effective on occurrence of contingency) Professional sanctions -- civil fines -- enforcement. (1) A physician or physician assistant who purposely or knowingly violates 50-20-1003 commits unprofessional conduct, and the person's license to practice medicine in Montana must be suspended for a minimum of 1 year pursuant to Title 37.
(2) A physician or physician assistant who purposely or knowingly delivers to the department a report required under 50-20-1004 that is known by the person to contain false information shall be subject to a fine of $2,000 imposed by the department.
(3) A physician or physician assistant who purposely or knowingly fails to file with the department a report required under 50-20-1004 shall be subject to a fine of $1,000 imposed by the department.
(4) The attorney general may enforce the provisions of this part on behalf of the department. The department also has the authority to bring an action.
