61-8-812. Suspension of commercial driver's license -- operation of out-of-service vehicle. (1) Upon receipt of information that a commercial motor vehicle operator has been convicted of a violation of operating a commercial motor vehicle that has been placed out of service, the department shall suspend the operator's commercial driver's license for 6 months for a first conviction and for 1 year for a second or subsequent conviction.
(2) A temporary or probationary commercial driver's license may not be issued while a commercial driver's license is suspended under subsection (1).
