80-5-113. Penalty. Any person, firm, or corporation which sells or offers or exposes for sale or distribution in the state any seed for seeding purposes without complying with the requirements of 80-5-102 through 80-5-105 and 80-5-107 through 80-5-113 is guilty of a misdemeanor and upon conviction shall be fined not less than $100 or more than $300 plus costs of such prosecution and upon conviction of the second or any subsequent offense shall be fined not less than $500 or more than $1,000 plus costs of such prosecution.
